Selected Successes
The matters below illustrate Conza McNamara’s experience representing clients in contested estates, probate proceedings, fiduciary disputes, and significant civil litigation. Every matter presents its own facts, risks, and objectives, and each requires a strategy built around the circumstances.
Contested Estate
In Re: Estate of Recasens
In this contested estate proceeding, our firm represented the Executor and successfully defended against a challenge to the decedent’s will by a family member who had been excluded from the will. Through extensive litigation and discovery, including S.C.P.A. 1404 examinations, our firm defeated the challenge and ensured that our client was appointed Executor and that the decedent’s wishes were carried out.
Probate Litigation
In Re: Estate of Pillai
Our firm represented the decedent’s spouse and proposed Executrix under the decedent’s will. We successfully challenged a purported subsequent will submitted by an alleged acquaintance of the decedent. The purported will would have disinherited our client. Our experience in the New York State Surrogate’s Court allowed us to defeat the alleged subsequent will and permit our client to proceed as sole beneficiary under the decedent’s will.
Probate Proceeding
In Re: Estate of Castaluzzo
In this probate proceeding, our firm represented the proposed Executor and successfully defeated a challenge by a family member to our client’s appointment. The decedent’s will was fully probated and the decedent’s wishes were fulfilled.

Civil Litigation
Yehuda Aminov v. Forest Diamonds
Our firm represented the defendant in an action for contribution under C.P.L.R. 1402, in which the plaintiff sought approximately $9,000,000 from our client in connection with a prior federal lawsuit between the parties. Through aggressive motion practice, we obtained a complete dismissal of the action against our client.
Action completely dismissed
Landlord-Tenant Litigation
Graham Street Owners Corp. v. Lewis Long
Our firm represented the tenant in a summary nonpayment proceeding. We asserted a counterclaim alleging rent overcharge in violation of the Rent Stabilization Law and sought treble damages. After a bench trial, we obtained dismissal of the nonpayment proceeding and secured a $117,000 money judgment in favor of our client.
We again prevailed when the landlord appealed to the Appellate Term and defeated the landlord’s attempt to further appeal to the Appellate Division. We subsequently obtained full payment of the judgment for our client.
and fully paid to the client
